These Website Terms of Use ("Terms") govern your access to and use of the public website at techorait.com (the "Website"), operated by TechoraIT ("TechoraIT", "we", "us" or "our").
These Terms govern use of the public Website only. They do not create, and are not, an agreement for managed IT, cloud, firewall, security, backup, support or any other professional service. Any such service is provided only under a separate signed agreement. The Hebrew version of these Terms is the controlling version for users in Israel, subject to applicable law. These Terms are not legal advice.
1. Operator and acceptance
The Website is operated by TechoraIT. You can reach us at support@techorait.com or 055-2905013.
By accessing or using the Website you agree to these Terms to the extent recognized by applicable law. If you do not agree, please do not use the Website. Provisions concerning liability, jurisdiction and important restrictions are set out clearly and are intended to be prominent; please read them.
2. Purpose of the Website
The Website provides general information about TechoraIT and its areas of activity, which include managed IT support, cloud services, Fortinet and firewall / network security, technical support, systems and infrastructure, automation, and backup and business continuity.
Public content on the Website is general information only. It is not, and must not be relied on as:
- A binding quotation or offer
- A guaranteed technical solution or result
- Professional, legal or security advice for your specific situation
- A security guarantee
- A substitute for a proper assessment of your particular environment
3. No automatic service relationship
Browsing the Website, sending us an email, or submitting the contact form does not, by itself, create any service relationship or impose any service obligation on TechoraIT. In particular, no such action creates:
- A customer relationship, retainer or engagement
- A service-level agreement (SLA) or response-time commitment
- A duty to monitor, manage, secure or maintain any system or network
- A duty to back up, restore or recover any data
- A duty to provide emergency or ongoing assistance
A contact-form submission is not acceptance of an engagement, and a quotation is not binding unless it is formally approved in accordance with its own terms. TechoraIT is not obliged to accept every request. Paid or managed services begin only under a separate written agreement, quotation, order form, statement of work or other authorized document. Any matter concerning an actual service supplied to a customer is governed by that signed agreement, and not by these Terms alone.
4. Accuracy and changes to content
We aim to keep public content accurate and current, but we do not warrant that it is complete, error-free or up to date at all times, and we may change public content at any time. This right to change public Website content does not allow us to change the terms of a concluded customer agreement, which can be changed only as that agreement provides.
5. Eligibility and authority
You may use the Website only if you can form a binding agreement under applicable law. If you submit information on behalf of a business, you confirm that you are authorized to make the inquiry on its behalf. This confirmation relates to making the inquiry only; it is not, and must not be treated as, authorization for TechoraIT to access, alter or connect to any of the business’s systems.
6. Permitted use
You may access and use the Website for lawful, personal or internal business purposes — to read the information provided and to contact us about our services. All use must comply with these Terms and with applicable law.
7. Prohibited use
You must not:
- Attempt to gain unauthorized access to the Website, its systems or any connected system
- Conduct malicious scanning, or attempt to exploit or bypass security controls
- Upload, transmit or distribute malware or other harmful code
- Interfere with, disrupt or overload the Website or its infrastructure
- Scrape, harvest or copy content in a manner that harms the service or infringes rights
- Impersonate any person or entity, or submit fraudulent or misleading requests
- Use the contact form to send spam or unsolicited commercial messages
- Infringe intellectual-property or other rights of TechoraIT or any third party
- Use the Website in violation of applicable law
This clause is not intended to prohibit good-faith, responsible security research. If you believe you have found a security vulnerability, please report it responsibly to our security contact rather than exploiting it, and do not access, alter or exfiltrate data that is not yours.
8. Intellectual property
The Website and its content — including the TechoraIT brand and logo, text, design, layout, graphics, diagrams, code, documentation and original media — are owned by TechoraIT or its licensors and are protected by applicable law. Except as expressly permitted, you may not copy, reproduce, modify, distribute or create derivative works from the content without our prior written permission.
Third-party names and marks — including Microsoft, AWS, Google Cloud, Fortinet and others — belong to their respective owners. Their mention describes technologies we work with and does not imply any partnership, endorsement or affiliation unless expressly stated.
9. Your submissions
When you submit information through the Website, you grant TechoraIT only the limited rights necessary to receive, review and respond to your inquiry and to keep appropriate records. We do not require you to transfer ownership of your content.
You confirm that you are permitted to submit the information you provide. Please do not submit:
- Passwords, private keys or production credentials
- Highly sensitive personal information that is not necessary for your inquiry
- Third-party confidential information without authorization
- Unlawful, infringing or harmful material
10. External services and providers
The Website relies on third-party providers, which may include hosting, email delivery, Microsoft 365, human-verification, content-delivery, telecommunications and cloud providers. Their availability and performance are partly outside our control. Our use of a provider does not disclaim any legal duty that applies to TechoraIT itself.
11. Website availability
We do not guarantee that the public Website will be available, uninterrupted, timely, secure or error-free at all times, and we may suspend, withdraw or restrict all or part of it for operational, security or other reasons. Public-Website availability is separate from, and must not be confused with, any service-level commitment made to a customer under a signed agreement.
12. Cybersecurity notice
- No public website or communication channel can be guaranteed to be immune from every cyber event.
- Do not send passwords, secrets, private keys or production credentials through the public contact form or by unsecured email.
- Any technical suggestion in public content is general and requires assessment specific to your environment before it is relied upon.
We describe our security practices honestly and apply reasonable safeguards; this notice does not disclaim any security duty that applies to us under law.
13. Limitation of liability
This section applies to your use of the public Website. It does not apply to, replace or limit the terms of any separate signed service agreement, under which liability for actual professional services is determined.
To the maximum extent permitted by applicable law, and subject to any mandatory right or remedy that cannot lawfully be excluded, TechoraIT will not be liable for loss or damage arising from:
- Reliance on general Website information without a signed engagement
- Temporary or permanent unavailability of the public Website
- Incompatibility of the Website with your device or configuration
- Unauthorized or unlawful use of the Website by you or others
- Third-party websites, content or services
- Interruptions or failures of third-party services outside our reasonable control
- Malicious attacks that occur despite reasonable safeguards
- Force-majeure events (as described below)
- Your failure to maintain appropriate security or backups, where no signed service obligation applies
To the maximum extent permitted by applicable law, and subject to any mandatory right or remedy that cannot lawfully be excluded, TechoraIT will not be liable for indirect, consequential, special or incidental damage, or for loss of profits, revenue, business opportunity or goodwill, business interruption, loss or corruption of data, the cost of reconstituting data, or third-party claims, arising from use of the public Website.
To the maximum extent permitted by applicable law, TechoraIT’s total aggregate liability arising from or relating to the public Website will be limited to a modest amount appropriate to a free, informational website, as set out in the applicable agreement or as determined by law. A specific monetary cap will be confirmed with legal advice before it is stated here.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for fraud, for intentional or reckless misconduct, or under mandatory consumer, privacy, data-security or other non-waivable law. A court may decline to enforce, or may modify, a term it considers unfair in a standard-form contract. This clause does not guarantee that a claim will fail or that TechoraIT will be found not liable.
14. Data, backup and cyber incidents
The public Website is not a backup, storage, recovery or security service. Do not use the contact form to store data or as a means of safeguarding information.
Any responsibility relating to customer data, backup, restoration, disaster recovery or cybersecurity services will be determined exclusively under the applicable signed service agreement and mandatory law. Nothing here states that TechoraIT is never responsible for data loss.
15. Work on customer equipment
These Terms concern the public Website only. Any liability relating to work performed on a customer’s equipment or systems is governed by the applicable signed service agreement, including the responsibilities, exclusions, handover records and liability limits set out there, and by mandatory law. Such terms do not apply to a person merely by using the Website.
16. Indemnity
To the extent permitted by law, you agree to indemnify TechoraIT for reasonable, documented loss it actually incurs that is directly caused by your: unlawful use of the Website; infringement of intellectual-property or other rights; malicious interference with the Website; unauthorized submission of third-party confidential information; or material breach of these Terms.
- This indemnity applies only where the loss is caused by your act or omission, and does not cover loss caused by TechoraIT’s own acts, negligence or breach of its legal duties.
- We will give you prompt notice of a relevant claim, and, where appropriate, allow you to participate in its defense.
- We will not settle a claim in a way that imposes an obligation on you without your appropriate consent.
17. Force majeure
TechoraIT will not be considered in breach of these Terms, and will not be liable, for any failure or delay in relation to the public Website that is caused by events beyond its reasonable control, including: war, terrorism, hostilities or civil emergency; governmental restrictions; natural disaster; widespread power failure; telecommunications, cloud or hosting outages; major cyberattack; labor disruption; or epidemic. This clause does not excuse any obligation that mandatory law does not permit to be excused. Force majeure affecting an actual customer service is governed by the applicable signed agreement.
18. Governing law and jurisdiction
These Terms and any use of the Website are governed exclusively by the laws of the State of Israel, without giving effect to conflict-of-laws rules that would refer the matter to foreign law. Subject to mandatory law and any non-waivable rules of subject-matter or territorial jurisdiction, the courts of competent jurisdiction located in Rishon LeZion shall have exclusive territorial jurisdiction over disputes concerning the Website or these Terms. If a particular proceeding cannot lawfully be heard by a competent court in Rishon LeZion, it shall be heard by the competent court in the Central District having the closest connection to Rishon LeZion.
This clause does not override mandatory consumer rights, small-claims jurisdiction rules, class-action law, or the powers of administrative or regulatory authorities, and does not guarantee that every claim will in fact be heard in Rishon LeZion.
19. Governing language
These Terms are provided in Hebrew and English. In the event of a discrepancy between the Hebrew and English versions, the Hebrew version will prevail, subject to applicable law. The versions are intended to be substantively equivalent.
20. General provisions
- Severability: If any provision is held unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in effect.
- No waiver: Our failure to enforce a provision is not a waiver of it or of any other provision.
- Assignment: You may not assign your rights or obligations under these Terms without our consent; we may assign them in connection with a reorganization or transfer of the business, subject to law.
- Entire agreement (Website): These Terms and the Privacy Policy are the entire agreement between you and TechoraIT regarding use of the public Website, and do not replace any separate signed service agreement.
- Relationship to the Privacy Policy: Our Privacy Policy explains how we handle information and forms part of these Terms for use of the Website.
- Headings: Headings are for convenience only and do not affect interpretation.
- Electronic communications: You agree that we may communicate with you electronically in connection with your use of the Website and your inquiry.
- Notices: Notices to TechoraIT may be sent to the contact details below; notices to you may be sent to the details you provide.
- Updates: We may update these Terms; the version and dates above show the current version, and material changes will be made noticeable. We will not change concluded contractual obligations retroactively without an appropriate basis and notice.
- Survival: Provisions that by their nature should survive termination — including intellectual property, limitation of liability, indemnity, governing law and jurisdiction — will survive.
- Third-party rights: These Terms do not create rights for any third party except as expressly stated.
